Mother Regains Custody of Special Needs Child

DUI & Marijuana Charges Withdrawn in Perry County

Attorney Timothy Czekaj recently helped a client in Perry County, who was charged with DUI, Possession of Marijuana, Possession of Paraphernalia, and Operation of Vehicle without Ignition Interlock. Due to the number of priors, the client was facing a minimum of one year in jail and a felony conviction.

Ultimately, all charges were dismissed by Commonwealth after attorney Czekaj’s Motion to Suppress Evidence based on lack of probable cause for the officer to initiate the traffic stop. The judge ruled in our favor, and with no evidence, the Commonwealth was forced to withdraw charges.

Prior to the successful motion, the best offer from the Commonwealth was to plead guilty and receive mandatory minimums. Attorney Czekaj examined the MVR recording from the traffic stop and determined that the officer actually did not have probable cause to initiate the stop, thereby making all evidence received as a result of the stop inadmissible.

Resisting Arrest Reduced in Perry County
